Terms and Conditions for The Backyard Barn Waxhaw

Please read these Terms and Condtions ("Terms", "Terms of Service") carefully before using The Backyard Barn Waxhaw website (www.thebackyardbarnwaxhaw.com) and engaging in our horseback riding lessons or other services.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Acceptance of Terms
By accessing or using The Backyard Barn Waxhaw website and services, the user agrees to be bound by these Terms and this Privacy Policy.
If a user disagrees with any part of the terms, they should not access the website or use the services.
2. Services Provided
The Backyard Barn Waxhaw provides the following services, subject to these Terms and any specific agreements for individual services:
Horseback Riding Lesson: Offering comprehensive instruction that includes both mounted riding and foundational unmounted horsemanship and horse husbandry. Lessons are available in private and open formats.
Equestrian Event Support: Guidance and preparation for student participation in various equestrian events, including local open horse shows, foxhunting, clinics, and other related activities.
Trailer-In Student Program: Providing facilities and instruction for students bringing their own horses to the barn (negative coggins test is required).
Age Restricitons for services: Lessons are offered for riders aged 5 years and older.

​3. User Obligations and Conduct
Registration/Booking:
Accurate Information: Users, or their legal guardians, agree to provide accurate, current, and complete information when registering for lessons, programs, or contacting us through the website.
Eligibility: By booking a service, you confirm that the participant meets any stated eligibility criteria including age requirements (e.g., "participants must be 5 years of age or older for riding lessons").
Parent/Guardian Consent (for Minors): For all participants under the age of 18 years a parent or legal guardian must complete the registration, booking, and agree to these Terms and all associated policies on the minor's behalf.The parent/guardian assumes full responsibility for the minor's compliance with all the rules and safety guidelines.
Agreement to Policies: By completing a registration or booking, you acknowledge and agree to abide by all The Backyard Barn Waxhaw's policies, including but not limited to these Terms & Conditions, the Safety Guidelines, The refund Policy, and the Cancellation Policy.
Safety Guidelines and Assumption of Risk:
All users, participants, and visitors on The Backyard Barn Waxhaw property and participating in our services must strictly adhere to all safety rules, instructions given by The Backyard Barn Waxhaw instructors and staff, and any posted barn policies or procedures. Participants acknowledge that horseback riding and equestrian activities inherently involve risks of serious injury, including but not limited to; bodily harm, disability, paralysis, and death. By participating, you voluntarily assume all risks associated with equestrian activities whether known or unknown, and agree to comply with all safety directives. Failure to comply with safety protocols or instructor directions may result in immediate termination of services, removal from the property,and forfeiture of any fees paid, without liability to The Backyard Barn Waxhaw.
Appropriate Attire: Participants must wear appropriate riding attire and approved safety gear (e.g., ASTM/SEI certified helmets) as specified by The Backyard Barn Waxhaw policies for all tacked mounted activities.
Respectful Behavior: All individuals on The Backyard Barn Waxhaw property are expected to exhibit respectful and courteous conduct towards staff, other students, visitors, horses, all other animals and property.
Coggins Test Requirement: For the health and safety of all horses on our property, any horse brought onto The Backyard Barn Waxhaw premises, including those belonging to trailer-in students, must have a current, negative Coggins test. Proof of a negative Coggins test must be provided upon request prior to the horse's entry.
Prohibited Activities: Unauthorized access to barn areas, misuse of equipment, disruptive and unsafe-behavior, and bringing unapproved animals onto the property are strictly prohibited.
Agreement to Policies: By completing a registration or booking, you acknowledge and afree to abide by all The Backyard Barn Waxhaw's policies, including but not limited to these Terms & Conditions, the Safety Guidelines, the Refund Policy, and the Cancellation Policy.
​4. Payments, Cancellations, and Refunds:
​Payment Terms: All fees for lessons, programs, or other services provided by The Backyard Barn Waxhaw are due and payable according to the pricing structure and payment schedule communicated at the time of booking or registration. Payments may be processed directly through our website via third-party payment processors [Paypal/Chime/Etc] or via other agreed-upon methods.
Cancellation Policy: Users are responsible for understanding and adhering to The Backyard Barn Waxhaw's cancellation policy for lessons and services. Specific details regarding cancellation deadlines, notification procedures, and any applicable cancellation fees or forfeiture of payments are outlines on our Lessons page and/or will be provided at the time of booking.
Refund Policy: All refunds are final. The Backyard Barn Waxhaw maintains a strict no-refund policy. By agreeing to these Terms, you acknowledge and agree to the terms set forth in our dedicated Refund Policy, which can be found on our Refund Policy page.

Participation in horseback riding lessons, horsemanship programs, clinics, events, and all other equestrian activities offered or facilitated by The Backyard Barn Waxhaw involves inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to, the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them; the unpredictability of an equine's reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals; collisions with other equines or objects; and the potential for a participant to act in a negligent manner that may contribute to injury to the participant or others. By engaging in any equestrian activity or entering The Backyard Barn Waxhaw premises, you, for yourself, your minor children, and all associated parties, voluntarily assume full responsibility for any and all risks of injury, death, or property damage arising from equine activities, whether caused by the negligence of The Backyard Barn Waxhaw, its owners, instructors, employees, agents, or any other cause. You agree to waive any and all claims you may have against The Backyard Barn Waxhaw for any injuries, damages, or losses sustained while participating in or observing equestrian activites. Liitation of Liability: In no event shall The Backyard Barn Waxhaw, its owners,directors, employees, affliates, agents, contractors, lisensors, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including withour limitation, loss of profits, data, use, goodwill, or other intangible losses, resulthing from (i) your access to or use of or inability to access or use the website; (ii), ay conduct or content of any third party on the website; (iii) any conent obtained from the website; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Governing Law and Jurisdiction​

Any legal action or proceeding arising under these Terms will be brought exclusively in the state orfederal courts located in Union Conty, North Carlina, United States, and you hereby consent to the personal jurisdiction and venue therein.
9. Changed to Terms
​Right to Modify: The Backyard Barn Waxhaw reserves the right, at its sole discretion, to modify or replace these Terms and Conditions at any time. Notification of Changes: We will provide reasonable notice of any material changes to tese Terms by posting the updated Terms on the website with a new "Effective Date" at the top, or by sending an email notifcation to the address associated with your account, or through a prominent notice on the website. Effective Date: Any changes to these Terms will become effective immediately upon their posting on the website, or on a later date specified in the notice. Continued Use Constitues Acceptance: Your continued use of the website and services following the posting of revised Terms ( or after the effective date of such changes) means that you accept and afree to the changes.
